  • Declaration of Acceptance and Responsibility

    These General Terms of Use and Commitment (hereinafter referred to as "General Terms"), together with the Privacy Policy, govern the access and use by the User of the website DROPECLOTHING.COM and its subdomains (hereinafter referred to as "the Site"), as well as the products and services contracted through it.

    By accepting these General Terms, the User declares:

    1. That they have read, understand, and comprehend the contents of this document;
    2. That they are of legal age and have the capacity to contract;
    3. That they assume all obligations set forth in this document.

    Use of the Site grants the status of User (hereinafter referred to as "the User") and implies acceptance of all the terms included in these General Terms. The User should carefully read these General Terms each time they access the Site, as both the Site and its General Terms may be modified.

    The Site owner reserves the right to make, at any time and without prior notice, any modifications or updates to its contents and services; to these General Terms; and, in general, to all elements that are part of the design and configuration of the Site.

    The Site owner is not responsible for any health damages that may be caused to the User due to improper or incorrect use of the products sold on the Site.

      2.1. Access to the Website

      Access to the Website is free, except for the telecommunication connection charges, provided by the supplier contracted by the User.


      2.2. Registration Requirement

      In general, to access the services and content of the Website, registration of the User will not be required. However, the User may opt for prior registration to access the Website more conveniently.
      The data entered by the User must always be accurate, up-to-date, and truthful. The registered User will always be responsible for the security of their password, thereby assuming the damages and losses that may result from its misuse, as well as from its cessation, disclosure, or loss. For this purpose, access to restricted areas and/or the use of services and content carried out under the password of a registered User will be considered as carried out by the said registered User, who will be responsible, in any case, for the said access and use.


      2.3. Website Usage Rules

      The User is obliged to use the Website, all its content and services, in accordance with the law, morals, public order, and these General Terms and Conditions. They are also required to use the services and/or content of the Website properly, without applying it to carry out illegal activities or crimes that violate the rights of third parties and/or that infringe intellectual and industrial property regulations or any other applicable legal norms.
      The User is obligated not to transmit, enter, disseminate, or make available to third parties any type of material or information (data, content, messages, drawings, sound and image files, photographs, software, etc.) that is contrary to the law, morals, public order, or these General Terms and Conditions. In a restrictive manner, and in no way limiting or excluding, the User undertakes to:
      I. Not to enter or disseminate content or propaganda of a racist, xenophobic, pornographic nature, or that promotes terrorism or any other type that violates human rights.
      II. Not to introduce or disseminate data programs (viruses and harmful software) likely to damage the computer systems of the access provider, its suppliers, or third-party Internet users.
      III. Not to disseminate, transmit, or make available to third parties any type of information, element, or content that could violate fundamental rights and public freedoms constitutionally recognized, as well as in international treaties.
      IV. Not to disseminate, transmit, or make available to third parties any type of information, element, or content that constitutes unlawful or unfair advertising.
      V. Not to transmit unsolicited or unauthorized advertising, promotional material, spam, “chain mails,” “pyramid schemes,” or any other form of solicitation, except in areas (such as commercial spaces) that have been exclusively designed for such purposes.
      VI. Not to introduce or disseminate false, ambiguous, or inaccurate information and content that may mislead the recipients of the information.
      VII. Not to impersonate other Users by using their registration passwords in different services and/or content on the Website.
      VIII. Not to disseminate, transmit, or make available to third parties any type of information, element, or content that implies a violation of intellectual and industrial property rights, patents, trademarks, or copyright that belong to the Website’s owners or third parties.
      IX. Not to disseminate, transmit, or make available to third parties any type of information, element, or content that implies a breach of communication secrecy and data protection legislation.

      The User is obligated to hold DROPE harmless from any possible claims, fines, penalties, or sanctions it may be required to bear as a result of the User’s failure to comply with any of the usage rules mentioned above. DROPE also reserves the right to claim the indemnity it is entitled to for any damages or losses.


      2.4. Disclaimer of Liability

      The User’s access to the Website does not imply any obligation for DROPE to control the absence of viruses or any other harmful computer elements. In any case, it is the User’s responsibility to provide the necessary tools to detect and disinfect harmful computer programs.
      DROPE is not responsible for any damages to the software and computer equipment of the Users, as well as of third parties, during the use of the services offered on the Website.
      DROPE is not responsible for any damages or losses of any kind caused to the User by failures or disconnections in the telecommunications networks, which may result in the suspension, cancellation, or interruption of the Website service during its provision or beforehand.


      2.5. Linked Content and Services through the Website

      The service of access to the Website includes links, lists, and even search tools that allow the User to access other websites and Internet Portals (hereinafter referred to as “Linked Websites”). In these cases, DROPE will only be responsible for the content and services provided on the Linked Websites, to the extent that it has actual knowledge of the illegality and has not taken steps to deactivate the link with due diligence. If the User considers that a Linked Website contains illegal or inappropriate content, they may report it to DROPE, without in any case requiring DROPE to remove the corresponding link.
      In no case does the existence of Linked Websites imply the formalization of agreements with the persons or entities responsible for them, nor does it imply the recommendation, promotion, or identification of DROPE with the exhibits, content, or services provided.
      DROPE is unaware of the content and services of the Linked Websites and, as such, is not responsible for any damages caused by illegality, quality, obsolescence, unavailability, errors, and the uselessness of the content and/or services of the Linked Websites, nor for any other damage that is not directly attributable to DROPE.
      In case the User may access or be redirected to Linked Websites that allow the contracting of services and/or products, the User acknowledges and agrees that DROPE acts solely as an intermediary by facilitating such access, and as such, will not be responsible, either directly or indirectly, for damages and losses of any kind resulting from the free use and/or contracting of such services and products from third parties, as well as for the lack of legality, reliability, utility, truthfulness, accuracy, completeness, and timeliness of such services and products.
      In a restrictive manner, and in no case limiting, DROPE will not be responsible for any damages and losses resulting from the incorrect performance or violation of contractual commitments made through third parties; from unfair competition and illegal advertising; from the non-adaptation and disappointment of expectations created by such third-party services and products, as well as any flaws and defects that may exist in them.


      2.6. Intellectual and Industrial Property

      All content on the Website, understood, but not limited to, as texts, photographs, graphics, images, icons, technology, software, links, and other audiovisual or sound content, as well as its graphic design and source code, are intellectual property of DROPE or third parties, and cannot be understood as assigned to the User, any of the exploitation rights recognized by current intellectual property regulations.
      The trademarks, trade names, or logos are the property of DROPE or third parties, and access to the Website cannot be understood as a right granted over them.
      By accepting these General Terms and Conditions, the User grants DROPE, free of charge and exclusively, all exploitation rights over the articles, comments, and opinions (hereinafter “Content”) published by the User, or whose publication they authorize on the Website.
      The User agrees to respect the intellectual and industrial property rights of DROPE and third parties, and the reproduction, transformation, distribution, or commercial use of any content from the Website without prior and express authorization is strictly prohibited.
      The User, who claims to have all intellectual property rights over the articles, comments, and opinions referred to above, is obligated to assume any claim or responsibility, including compensation for damages and losses, that a third party may assert against DROPE, for infringing their rights by any action arising from the obligations the User assumes, directly or indirectly, under these General Terms and Conditions.
      The User is also obligated to keep DROPE harmless from any loss or damage that they or a third party may suffer as a result of the formalization of the rights assignment regulated in this clause.


    • 3. Terms of Commitment

      3.1. Images and Product Availability

      We request that if you encounter any type of error, you inform us so that we can proceed with the correction as quickly as possible, for the benefit of all Users.
      Similarly, we advise that when purchasing any product on this page, you confirm that the product name is the one you desire.
      All product orders will be subject to their availability.


      3.2. Purchase Procedure

      The procedure to buy products through the Online Store on the Site is as follows:

      1. Start the process by selecting the product you wish to buy, then enter the desired size/color/quantity and click on the “Add to Cart” button that appears below each product.
      2. In the cart, the User should click “Next” or “Order” after confirming the products in the cart.
      3. In the next step, the User will need to create an account or just log in to enter their address, in order to ensure the correct receipt of their order. Then, click the “Place Order” button.
      4. If the User has a discount or gift coupon, they must include it in the shopping cart in the section provided to enter the coupon (“Coupons”). If the coupon is not entered in the space mentioned above, and the order is placed without the discount, the User will not be able to later request the application of the discount after the order confirmation.
      5. In the “Shipping” section, the User will be able to see the name of the courier company that will deliver the order within the expected timeframe and the price of this service, which will be added to the total order price. Click “Continue.”
      6. Select one of the available payment methods.
      7. Finally, click the “Pay Securely” button. The User will receive confirmation of their order acceptance through a message on the screen and an email, previously provided.


      3.3. Prices and Payment Methods

      All prices published on the Site, unless otherwise expressly stated, include the corresponding VAT.
      The User can make the payment via bank transfer, PayPal, credit card (VISA, VISA Electron, Maestro, Mastercard), Service Payments, or Cash on Delivery, if available.
      To make the payment via bank transfer, the User should make a transfer using the details provided in the order confirmation email. Here, the bank account number to which the transfer should be made, the amount, and the reference that should be attached to expedite the final acceptance of the order will be indicated. The order will be processed once the full amount is received.
      The delivery period communicated to the customer starts counting from the complete receipt of the amount in the account. The order made via bank transfer is valid for 48 hours. Any payment made after this period may be subject to changes in product availability or additional costs.


      3.4. Order Delivery and Returns

      The products purchased by the User will be shipped via CTT, Nacex, or DHL. The shipping costs will be borne by the customer if indicated before completing the order; otherwise, they will be borne by DROPE.
      Order delivery will be made to the delivery address freely designated by the User on the order form. DROPE will not assume any responsibility if the delivery of the product is not made due to inaccuracies or falsehoods in the data provided by the User, or in the event that delivery cannot be made due to causes beyond the control of the designated courier companies (CTT, Nacex, DHL), such as the absence of the recipient. Order processing may take up to 48 hours on working days. The order will be delivered as soon as possible and, in any case, always within ten (10) working days from the order confirmation date.
      Exchanges are allowed provided they are requested within 15 days from the shipment date. However, the commercialized product cannot show any signs of use and must be returned in its original packaging. Products used beyond simple trial will not be eligible for exchange or return. After receiving the defective item, DROPE reserves the right to refuse the exchange if the item does not meet the requirements of this policy. Exchanges will be processed within 3 to 5 working days after receiving the returned item. Return shipping costs are borne by the customer, while the cost of shipping the new product will be borne by DROPE.
      In the event that an exchange is not possible, the User will be given the option to choose another product with the same characteristics or, as a last resort, a refund will be issued.


      3.5. International Deliveries

      Shipments made to Europe have a delivery timeframe of 3 to 8 working days. Shipments to the rest of the world are delivered within 3 to 10 working days.
      The product prices may be displayed in various currencies, but all orders will be transacted in Euros by your bank after completing the purchase.
      If the purchase is made in a currency other than Euro, the amount displayed at checkout is only an estimate, based on updated exchange rates, excluding taxes, customs duties, fees, or applicable charges.

    • 4. Cancellation and Ineffectiveness of Clauses

      If any of the clauses included in these General Terms and Conditions is declared, either totally or partially, null or ineffective, such cancellation or ineffectiveness shall only affect the specific provision or the part of it that is declared null or ineffective, with the remainder of these General Terms and Conditions remaining in full force, and the provision in question, either totally or partially, shall be considered as not included.

      These General Terms and Conditions are governed by and construed in accordance with the laws of Portugal.
