2. Terms of Use
2.1. Access to the Website
Access to the Website is free, except for the telecommunication connection charges, provided by the supplier contracted by the User.
2.2. Registration Requirement
In general, to access the services and content of the Website, registration of the User will not be required. However, the User may opt for prior registration to access the Website more conveniently.
The data entered by the User must always be accurate, up-to-date, and truthful. The registered User will always be responsible for the security of their password, thereby assuming the damages and losses that may result from its misuse, as well as from its cessation, disclosure, or loss. For this purpose, access to restricted areas and/or the use of services and content carried out under the password of a registered User will be considered as carried out by the said registered User, who will be responsible, in any case, for the said access and use.
2.3. Website Usage Rules
The User is obliged to use the Website, all its content and services, in accordance with the law, morals, public order, and these General Terms and Conditions. They are also required to use the services and/or content of the Website properly, without applying it to carry out illegal activities or crimes that violate the rights of third parties and/or that infringe intellectual and industrial property regulations or any other applicable legal norms.
The User is obligated not to transmit, enter, disseminate, or make available to third parties any type of material or information (data, content, messages, drawings, sound and image files, photographs, software, etc.) that is contrary to the law, morals, public order, or these General Terms and Conditions. In a restrictive manner, and in no way limiting or excluding, the User undertakes to:
I. Not to enter or disseminate content or propaganda of a racist, xenophobic, pornographic nature, or that promotes terrorism or any other type that violates human rights.
II. Not to introduce or disseminate data programs (viruses and harmful software) likely to damage the computer systems of the access provider, its suppliers, or third-party Internet users.
III. Not to disseminate, transmit, or make available to third parties any type of information, element, or content that could violate fundamental rights and public freedoms constitutionally recognized, as well as in international treaties.
IV. Not to disseminate, transmit, or make available to third parties any type of information, element, or content that constitutes unlawful or unfair advertising.
V. Not to transmit unsolicited or unauthorized advertising, promotional material, spam, “chain mails,” “pyramid schemes,” or any other form of solicitation, except in areas (such as commercial spaces) that have been exclusively designed for such purposes.
VI. Not to introduce or disseminate false, ambiguous, or inaccurate information and content that may mislead the recipients of the information.
VII. Not to impersonate other Users by using their registration passwords in different services and/or content on the Website.
VIII. Not to disseminate, transmit, or make available to third parties any type of information, element, or content that implies a violation of intellectual and industrial property rights, patents, trademarks, or copyright that belong to the Website’s owners or third parties.
IX. Not to disseminate, transmit, or make available to third parties any type of information, element, or content that implies a breach of communication secrecy and data protection legislation.
The User is obligated to hold DROPE harmless from any possible claims, fines, penalties, or sanctions it may be required to bear as a result of the User’s failure to comply with any of the usage rules mentioned above. DROPE also reserves the right to claim the indemnity it is entitled to for any damages or losses.
2.4. Disclaimer of Liability
The User’s access to the Website does not imply any obligation for DROPE to control the absence of viruses or any other harmful computer elements. In any case, it is the User’s responsibility to provide the necessary tools to detect and disinfect harmful computer programs.
DROPE is not responsible for any damages to the software and computer equipment of the Users, as well as of third parties, during the use of the services offered on the Website.
DROPE is not responsible for any damages or losses of any kind caused to the User by failures or disconnections in the telecommunications networks, which may result in the suspension, cancellation, or interruption of the Website service during its provision or beforehand.
2.5. Linked Content and Services through the Website
The service of access to the Website includes links, lists, and even search tools that allow the User to access other websites and Internet Portals (hereinafter referred to as “Linked Websites”). In these cases, DROPE will only be responsible for the content and services provided on the Linked Websites, to the extent that it has actual knowledge of the illegality and has not taken steps to deactivate the link with due diligence. If the User considers that a Linked Website contains illegal or inappropriate content, they may report it to DROPE, without in any case requiring DROPE to remove the corresponding link.
In no case does the existence of Linked Websites imply the formalization of agreements with the persons or entities responsible for them, nor does it imply the recommendation, promotion, or identification of DROPE with the exhibits, content, or services provided.
DROPE is unaware of the content and services of the Linked Websites and, as such, is not responsible for any damages caused by illegality, quality, obsolescence, unavailability, errors, and the uselessness of the content and/or services of the Linked Websites, nor for any other damage that is not directly attributable to DROPE.
In case the User may access or be redirected to Linked Websites that allow the contracting of services and/or products, the User acknowledges and agrees that DROPE acts solely as an intermediary by facilitating such access, and as such, will not be responsible, either directly or indirectly, for damages and losses of any kind resulting from the free use and/or contracting of such services and products from third parties, as well as for the lack of legality, reliability, utility, truthfulness, accuracy, completeness, and timeliness of such services and products.
In a restrictive manner, and in no case limiting, DROPE will not be responsible for any damages and losses resulting from the incorrect performance or violation of contractual commitments made through third parties; from unfair competition and illegal advertising; from the non-adaptation and disappointment of expectations created by such third-party services and products, as well as any flaws and defects that may exist in them.
2.6. Intellectual and Industrial Property
All content on the Website, understood, but not limited to, as texts, photographs, graphics, images, icons, technology, software, links, and other audiovisual or sound content, as well as its graphic design and source code, are intellectual property of DROPE or third parties, and cannot be understood as assigned to the User, any of the exploitation rights recognized by current intellectual property regulations.
The trademarks, trade names, or logos are the property of DROPE or third parties, and access to the Website cannot be understood as a right granted over them.
By accepting these General Terms and Conditions, the User grants DROPE, free of charge and exclusively, all exploitation rights over the articles, comments, and opinions (hereinafter “Content”) published by the User, or whose publication they authorize on the Website.
The User agrees to respect the intellectual and industrial property rights of DROPE and third parties, and the reproduction, transformation, distribution, or commercial use of any content from the Website without prior and express authorization is strictly prohibited.
The User, who claims to have all intellectual property rights over the articles, comments, and opinions referred to above, is obligated to assume any claim or responsibility, including compensation for damages and losses, that a third party may assert against DROPE, for infringing their rights by any action arising from the obligations the User assumes, directly or indirectly, under these General Terms and Conditions.
The User is also obligated to keep DROPE harmless from any loss or damage that they or a third party may suffer as a result of the formalization of the rights assignment regulated in this clause.
